Haw. Code R. § 6-62-8 - Insurance requirements
(a) No motor
carrier may operate upon or use the public streets or highways of the State
until it has filed with the commission evidence of security for the protection
of the public. The security may be in the form of insurance with an insurance
company authorized to do business in the State or surety bonds undertaken
either by firms authorized to do business in the State or by at least two
individual sureties or the security may be by qualification as a
self-insured.
(b) The security for
a motor carrier of passengers shall be in the following amounts:
(1) Liability coverage for bodily injury or
death, per person, in an amount no less than $100,000; and
(2) Liability coverage for bodily injury or
death, per accident, in amounts no less than:
(A) $200,000 for a vehicle with a seating
capacity of 7 passengers or less;
(B) $500,000 for a vehicle with a seating
capacity of 8-to-25 passengers; and
(C) $1,000,000 for a vehicle with a seating
capacity of over-25 passengers.
(3) Liability coverage for property damage,
per accident, in an amount no less than $50,000.
(c) The security for a motor carrier of
property shall be in the following amounts:
(1) Liability coverage for bodily injury or
death, per person, in an amount no less than $250,000;
(2) Liability coverage for bodily injury or
death, per accident, in an amount no less than $750,000; and
(3) Liability coverage for property damage,
per accident, in an amount no less than $250,000.
(d) Motor carriers of passengers and property
must be in compliance with the applicable requirements of subsections (b) and
(c) by July 1, 2001.
