Haw. Code R. § 8-63-75 - Formal complaint process
(a) If the
complaint is denied through the administrative review process, the complainant
shall be entitled to file a formal complaint within ten calendar days after the
notice of administrative review decision.
(b) Upon receipt of the formal complaint, the
assistant superintendent or designee shall review the complaint and issue a
written decision within ten calendar days after completion of the formal
review. If the complaint is:
(1) Denied and
the matter is within the jurisdiction of the merit appeals board, information
on filing a formal appeal with the merit appeals board shall accompany the
written decision; or
(2) Denied and
the matter is not within the jurisdiction of the merit appeals board, the
decision on the complaint shall be final and binding, unless the matter is
within the proper jurisdiction of another body or agency.
