Ill. Admin. Code tit. 17, § 525.70 - Business Practices
a) It is
unlawful for any person to wantonly or carelessly injure or destroy, in any
manner whatsoever, any real or personal property on the land of another while
engaged in activities permitted by this Section. Violation is a Class B
misdemeanor (see Section 2.33(x) of the Code).
b) Taking of fauna on private properties by
Class A and Class D permittees requires the landowner's or tenant's written
permission. Violation is a Class B misdemeanor (see Section 2.33(t)of the
Code).
c) Taking of fauna on
State-owned, -leased, or -managed lands requires written authorization from the
Site Superintendent or District Wildlife Biologist.
d) Permittees shall describe to the persons
seeking services the estimated cost and types of methods to be used to
alleviate damage to property, risks to human health or safety, and nuisances
caused by protected species.
e)
Class A and D permittees shall issue a receipt to each client showing the
permittee's name and address or name and address of the business he or she
represents, the client's name and address, services provided, and fees charged
for services.
f) Class A, B and C
permittees shall maintain accurate records of services provided to clients
under authority of this Section and submit an annual report to the Department
showing the following information: number of complaints serviced; name, address
and phone number of the permittee; number and kinds of animals relocated,
killed and surrendered to rehabilitators; name, address and phone number of any
site supervisor, tenant or landowner on whose property animals were released;
and locations where animals were released. This report shall be made on or
before January 20 and shall include all operations for the period from January
1 through December 31 of the previous year.
g) Class D and E permittees shall maintain
accurate records of services provided to clients under authority of this
Section and submit an annual report to the Department on forms provided by the
Department showing the following information for each property where services
were rendered: site name (if any); street address, city and county where
services were rendered; name, address and phone number of the landowner, tenant
or property manager where activities occurred; and the species and number of
nests, eggs or migratory birds destroyed. Reports shall be made on or before
September 1 of each year and include activities conducted from September 2
through August 31 of the most recent 12-month period.
h) Reports and records required by this
Section shall be available for inspection, upon request, by any officer or
authorized employee of the Department, any sheriff or deputy sheriff, or any
other peace officer at any reasonable time.
