Ill. Admin. Code tit. 35, § 405.102 - Standard for Permit Issuance or Certification
a) The Agency will issue or certify a permit
if the operator submits adequate proof that the mine related facilities and
mining activities will be constructed, prepared and operated without causing a
violation of the Act or Subtitle D.
b) The Agency may issue an experimental
permit under 35 Ill. Adm. Code
405.107 despite subsection
(a).
