Ill. Admin. Code tit. 50, § 8000.50 - Retroactive Approval

Section 143.29(b) of the Illinois Insurance Code (Chapter 73, Illinois Revised Statutes) provides in part that An insured who has completed the course of instruction prior to the effective date of this amendatory Act of 1981 shall receive the insurance premium reduction for only the period remaining within the 3 years from course completion. In order to fulfill this provision any course and sponsoring agency other than the National Safety Council's Defensive Driving Course, delivery agency, and/or instructor which requests approval prior to July 1, 1982, shall submit the properly completed application for approval and an affidavit affirming that such course and sponsoring agency, delivery agency, and/or instructor were in compliance with the requirements of this Part during the period for which the approval is requested. The affidavit shall be signed by both the sponsoring and delivery agency and shall specify the period of time for which approval is being requested but such retroactive approval shall not be granted prior to November 12, 1981 or the date on which the course and sponsoring agency, delivery agency, and/or instructor were in compliance with this Part. The Program Administrator may take whatever steps are necessary to verify the statements set forth in the affidavit and/or application.
