Ill. Admin. Code tit. 86, § 3000.415 - Discovery
a) Upon written
request served on the opposing party, a party shall be entitled to:
1) The name and address of any witness who
may be reasonably expected to testify on behalf of the opposing party;
and
2) All documents or other
materials in the possession or control of the opposing party which the opposing
party reasonably expects will be necessary to introduce into evidence.
Petitioner's burden of production includes those documents Petitioner
reasonably expects to introduce into evidence either in his case-in-chief or in
rebuttal. Rebuttal documents, to the extent they are not immediately
identifiable, shall be tendered to Respondent within two weeks after receipt of
documents tendered to Petitioner by Respondent unless additional time is
granted by the hearing officer.
b) Discovery may be obtained only through
written requests to produce witness lists, documents or other materials, as
specified in subsection (a) of this Section. Witnesses and documents responsive
to a proper request for production that were not produced shall be excluded
from the hearing and additional sanctions or penalties may be
imposed.
