Ill. Admin. Code tit. 89, § 338.50 - What May Not Be Appealed
The following circumstances are not appropriate for the appeal process:
a) when the Department has
already made a final administrative decision on the issue as a result of a
previous appeal;
b) when a court
has made a judicial decision on the issue being appealed; or
c) when the appellant has not met the time
frame for requesting an appeal.
