Ill. Admin. Code tit. 92, § 1206.30 - Burden of Proof
a) The burden
of proof in an investigation and suspension proceeding (proceeding in which a
rate is investigated and suspended) shall be on the proponent of the rate
unless otherwise provided in a valid preemptive federal statute which governs
the rate (Ill. Rev. Stat. 1985, ch. 951/2, par. 18c-3204(2)(C)).
b) The burden of proof in a rate complaint
proceeding shall be on the person who filed the rate complaint.
