Any person may file with the department a petition requesting
a waiver, in whole or in part, of a rule of the department on the ground that
the application of the rule to the particular circumstances of that person
would qualify for a waiver
A petition for a waiver must be submitted in writing to the
Iowa Department of Administrative Services, Office of the Director, Hoover
State Office Building, Third Floor, Des Moines, Iowa 50319-0104, Attention:
Legal Counsel. Requests for waiver may be delivered, mailed, sent by facsimile
transmission or by other electronic means reasonably calculated to reach the
intended recipient.
(1)
Appeals. If the petition relates to a pending appeal or
contested case, a copy of the petition shall also be filed in the appeal
proceeding or contested case using the caption of the appeal or contested
case.
(2)
Other.
If the petition does not relate to an appeal or contested case, the petition
will be submitted to the department's legal counsel.
