Iowa Admin. Code r. 161-4.8 - Subpoenas
(1)
Issuance of subpoenas.
a. A
commission subpoena shall be issued to a party upon request. Such a request
should be in writing, but oral requests may be honored by the presiding officer
The request shall include the name, address, and telephone number of the
requesting party. The presiding officer may issue a subpoena, or a subpoena for
the production of documentary evidence, signed but otherwise in blank to a
party requesting it, who shall fill it in before service.
b. Parties are responsible for service of
their own subpoenas and payment of witness fees and mileage expenses.
(2)
Motion to quash or
modify. The presiding officer may quash or modify a subpoena for any
lawful reason upon motion in accordance with the Iowa Rules of Civil Procedure.
A motion to quash or modify a subpoena shall be set for argument
promptly.
