Each public agency will provide the department with
information necessary to enable the department to carry out its duties under
Part B of the Act and this chapter, including, with respect to
34 CFR Section
300.157, information relating to the
performance of children with disabilities participating in programs carried out
under Part B of the Act. This information, including such quantitative and
qualitative data as the department may demand, is to be submitted in a manner
and at a time determined by the department. Failure to submit timely and
accurate information may be considered by the department in making the
determinations under rule
281-41.603 (256B, 34CFR300) or
in taking any other action to enforce Part B of the Act or this
chapter.
