Iowa Admin. Code r. 441-98.18 - [Effective 4/1/2025] Termination of income withholding
Child support services may, by ex parte order, terminate an income withholding order under the following conditions:
(1)
Order entered in error.
Child support services will terminate an income withholding order upon
determination that the order was entered in error as follows:
a. The person named as the obligor in the
income withholding order is not the person required to provide support under
the support order being enforced.
b. For orders resulting from the existence of
a delinquency, the required minimum delinquency did not exist at the time the
income withholding order was entered.
(2)
No support due. In cases
for which services are being provided by child support services, child support
services will terminate an income withholding order previously entered by child
support services when the current support obligation has terminated and when
the delinquent support obligation has been fully satisfied as applicable to all
of the children covered by the income withholding order. In no case will
payment of overdue support be the sole basis for termination of
withholding.
(3)
Other
circumstances. Child support services may revoke an income withholding
order under other circumstances provided the conditions of Iowa Code chapter
252D are met.
