Iowa Admin. Code r. 641-15.1 - Applicability
(1) These rules
apply to swimming pools, spas, wading pools, water slides, wave pools, spray
pads, and bathhouses connected to swimming pools owned or operated by local or
state government, or commercial interests or private entities including, but
not limited to, public or private school corporations, hotels, motels, camps,
apartments, condominiums, health clubs and country clubs. These rules do not
apply to a residential swimming pool or spa that is permanently installed in a
single-family dwelling, to a decorative fountain , or to a therapeutic swimming
pool or spa which is under the direct supervision of qualified medical
personnel.
(2) These rules do not
apply to a swimming pool or spa operated by a homeowners association
representing 72 or fewer dwelling units if the association bylaws, which also
apply to a rental agreement relative to any of the dwelling imits, include an
exemption from the requirements of this chapter, provide for inspection of the
swimming pool or spa by an entity other than the department or a local
inspection agency , and assume any liability associated with operation of the
swimming pool and spa . The association shall notify the department in writing
if the association bylaws are amended as above. The inspector designated by the
association shall be a certified operator as defined in 15.3(1). A report of
the inspection shall be filed with the association secretary and shall be
available to any association member on request.
