Iowa Admin. Code r. 641-202.13 - Request for extension of certificate
(1) A request by
the applicant for an extension of a certificate of need should be filed with
the department using the form available on the certificate of need web page no
later than 30 days prior to the expiration of the certificate of
need.
(2) A request for extension
should fully identify the project and indicate the current status of the
project in descriptive terms.
(3)
Any affected person has the right to submit to the department in writing, or
orally at the council meeting at which the extension request is considered,
information that may be relevant to the question of granting an
extension.
(4) When an extension
has been requested, the council will approve or deny the request at a meeting
of the council preceding the expiration of the certification. The certificate
of need may be revoked by the council at the end of the certification period
for insufficient progress in developing the project.
(5) If the extension is denied, the applicant
has the right to appeal under the provisions of Iowa Code section
10A.720.
