The resident director may reject any applicant or, after
examination, may refuse to certify any applicant if it is found that the
person:
1. Does not meet the minimum
required qualifications for the classification;
2. Is unable to perform the essential
functions of the position with or without a reasonable accommodation;
3. Has violated federal or state law or
regulations that affect the ability to perform the job;
4. Has unauthorized access to examination
information;
5. Has failed to
appear for examination or participate in any aspect of the selection
process;
6. Has failed to meet the
conditions of employment such as physical requirements, background checks, or
other conditions as set forth in the job announcement;
7. Has made false statements or attempts to
practice fraud or deception during the selection process;
8. Entered into a written agreement between
the applicant and the state or regents institutions that the applicant will not
seek or accept work from the state, any regents institution, or both;
9. Has been dismissed from private or public
service for a cause that would be detrimental to the regents institution
employing the applicant.
A disqualified applicant will promptly be notified by
electronic or ordinary mail of such action at the last-known address. A
disqualified applicant may request, in writing, review of the reason for
disqualification within ten days of notification. Upon receipt, the resident
director will give full consideration to the request and notify the applicant
by electronic or ordinary mail of the resident director's decision in writing
within ten days of receipt.
