Iowa Code r. 11-100.3 - Smoking
(1) Use of tobacco
products is prohibited in all space in capitol complex buildings controlled by
the executive branch including tunnels and enclosures, unless otherwise
designated by appropriate signs. The department shall post signs at the
entrances to capitol complex buildings to publicize this rule.
NOTE: The secretary of the senate, the clerk of the house and the court administrator are responsible for areas under their control.
(2) Use of tobacco
products is prohibited on the grounds of the capitol complex, except as
permitted by the director in designated areas or structures designated for
smoking. The department shall post signs at designated smoking areas.
(3) This rule shall be enforced by peace
officers of the department of public safety. Peace officers other than those
employed by the department of public safety may enforce this rule at the
request of the commissioner of public safety or at the request of a peace
officer employed by the department of public safety.
This rule is intended to implement Iowa Code section 8A.322 and chapter 142D and Executive Order Number 68 signed November 23, 1998, by Governor Terry Branstad.
