Iowa Code r. 441-98.10 - Approval of request for immediate income withholding
When the obligee or other party to the proceeding requests immediate withholding, child support services will determine whether the request will be approved.
(1)
Basis for approval. Approval of a request for immediate income
withholding by child support services may be based on:
a. Past payment record of the obligor that
demonstrates an inconsistent compliance with the support order.
b. Whether the state of Iowa is providing
public assistance.
(2)
Request denied. Child support services may not approve a
request for immediate income withholding on cases where no public assistance
has been expended and there is a prior written agreement between the obligee
and obligor that has been approved by court order.
