Iowa Code r. 481-105.9 - Procedure for denial, revocation, or suspension of a registration
(1) The department
may revoke, suspend, or deny a registration issued pursuant to Iowa Code
section 99B.56 for cause following 30
days' written notice delivered by certified mail, return receipt requested, or
by personal service and an opportunity for hearing pursuant to
481-105.8 (10A,99B).
(2) If the registrant has not requested a
hearing within the prescribed time period, the department may affirm, modify or
set aside the department's proposed action in the department's final written
decision.
(3) The department may
suspend a registration prior to a hearing if the director determines that the
public integrity of the registered activity is compromised or that there is a
risk to public health, safety, or welfare.
(4) The department may rescind the notice of
revocation, suspension, or denial at any point prior to hearing when the
department becomes satisfied that the reasons for revocation, suspension, or
denial have been or will be removed.
(5) The department shall send by certified
mail, return receipt requested, or shall serve personally upon the applicant or
registrant a copy of the department's final decision.
(6) If the department finds cause for denial
of a registration, the applicant shall not reapply for registration of an
amusement device for two years.
(7)
If the department finds cause for revocation or suspension, the department
shall suspend or revoke the registration for a period not to exceed two
years.
(8) In addition to the
suspension or revocation, a registrant that allows an individual under the age
of 21 to operate an electrical or mechanical amusement device may also be fined
for a scheduled violation pursuant to Iowa Code sections
805.8C(4) and
805.8C(5).
