Kan. Admin. Regs. § 100-76-8 - Professional incompetency; definition

As used in K.S.A. 2017 Supp. 65-7616 and amendments thereto and this article of the board's regulations, professional incompetency shall mean any of the following:

(a) One or more instances involving failure to adhere to the applicable standard of care to a degree that constitutes gross negligence, as determined by the board;
(b) repeated instances involving failure to adhere to the applicable standard of care to a degree that constitutes ordinary negligence, as determined by the board; or
(c) a pattern of practice or other evidence of incapacity or incompetence to engage in the practice of acupuncture.
