Kan. Admin. Regs. § 115-30-4 - Fire extinguishers; requirements
(a) United States coast guard approved hand
portable fire extinguishers of size I type B, size II type B, size 5 type B,
size 20 type B, or both size 5 type B and size 20 type B shall be carried on
board each motorboat as determined by the model year and class of vessel.
Portable fire extinguishers on a vessel shall be replaced upon 12 years from
the date of manufacture. As codified in 33 C.F.R. pt. 175 (2023), all fire
extinguishers that are replaced on a vessel shall be replaced with a size 5
type B or size 20 type B fire extinguisher that is not more than 12 years old.
(1) Class A: for model year vessel 2018 and
newer, at least one size 5 type B fire extinguisher that is date stamped shall
be carried. Vessels older than model year 2018 may carry either size 5 type B
or size I type B if any one or more of the following conditions exist:
(A) an inboard engine;
(B) closed compartments under thwarts and
seats where portable fuel tanks may be stored;
(C) double bottom construction not sealed to
the hull or not completely filled with flotation materials;
(D) closed compartments in which combustible
or flammable materials are stored; or
(E) permanently installed fuel tanks. Fuel
tanks that cannot be moved in case of fire or other emergency or if the weight
of the fuel tank precludes movement of the tank by an individual on board shall
be considered permanently installed.
(2) The provisions of subsection (1) shall
not apply if the motorboat has a United States coast guard approved built-in or
affixed fire extinguisher in the motor area.
(3) Class 1: for model year vessel 2018 and
newer, at least one size 5 type B fire extinguisher that is date stamped shall
be carried. Vessels older than model year 2018 may carry either size 5 type B
or size I type B. Provisions of this subsection shall not apply if the
motorboat has a United States coast guard approved built-in or affixed fire
extinguisher in the motor area.
(4)
Class 2: for model year vessel 2018 and newer, at least two size 5 type B fire
extinguishers or one size 20 type B fire extinguisher that is date stamped
shall be carried. Vessels older than model year 2018 shall carry two size 5
type B, one size 20 type B, two size I type B, or one size II type B fire
extinguisher. Each motorboat that has a United States coast guard approved
built-in or affixed fire extinguisher in the motor area shall only be required
to carry size I type B fire extinguisher, for vessels older than model year
2018, or one size 5 type B fire extinguisher, for any age vessel.
(5) Class 3: for model year vessel 2018 and
newer, at least three size 5 type B fire extinguishers or two size 20 type B
fire extinguishers that are date stamped shall be carried. Vessels older than
model year 2018 shall carry three size 5 type B, two size 20 type B, three size
I type B, or two size II type B fire extinguishers. Each motorboat that has a
United States coast guard approved built-in or affixed fire extinguisher in the
motor area shall only be required to carry two size I type B fire
extinguishers, for vessels older than model year 2018, or one size 20 type B
fire extinguisher, for any age vessel.
(b) Each vessel, including each motorboat
having an approved built-in or affixed fire extinguisher in the motor area,
that has enclosed living spaces or galleys shall carry at least one United
States coast guard approved size I type B or size II type B fire extinguisher
in the living space or galley.
