Kan. Admin. Regs. § 129-9-12 - Evidentiary standard; burden of proof
(a) Unless preempted by federal or state law,
a preponderance of the evidence shall be the evidentiary standard used for
state fair hearings under this article of the division's regulations.
(b) Any appellant or respondent may sustain
that individual's burden of proof by using testimony, documents, statutes,
regulations, the state plan and its amendments, the MCE contract, and policy to
support the appellant's or respondent's case.
