Kan. Admin. Regs. § 28-29-9 - Suspension of permits
(a) A permit shall
be suspended by the department when in the opinion of the secretary this action
is necessary to protect the public health or welfare, or the environment. The
secretary shall notify the permittee of the suspension and the effective date.
At the time of giving this notice, the secretary shall identify items of
noncompliance with the requirements of these regulations or with conditions of
the permit and shall specify deficiencies which the permittee shall correct,
actions which the permittee shall perform, and the date or dates by which the
permittee shall submit a plan detailing corrective action taken or to be taken
in order to achieve compliance.
(b) The suspension shall remain in effect
until the deficiencies are corrected to the satisfaction of the secretary or
until the secretary makes a final determination based on the outcome of a
hearing requested by the permittee under the provision of
K.S.A. 65-3412 or amendments of that statute. The
determination may result in termination of the suspension, continuation of the
suspension, or modification or revocation of the permit.
(c) Permits shall be suspended for failure to
pay the permit fee required by
K.S.A. 65-3407 or amendments of that statute.
