Kan. Admin. Regs. § 30-47-805 - Background checks
(a) With each
initial application, the applicant shall submit documentation for each
individual at least 18 years of age or older to request a fingerprint-based
background check from the national crime information center (NCIC) database and
for each individual at least 10 years of age to request a background check by
the Kansas bureau of investigation and a background check by the Kansas
department for children and families in order to comply with
K.S.A. 65-516, and amendments thereto. Each request
shall be submitted to the department on a form provided by the department. The
request shall list the required information for the following:
(1) Each individual at least 10 years of age
who resides in the family foster home, excluding children placed in foster
care; and
(2) each substitute
caregiver at least 14 years of age who provides care for a child in foster care
in the family foster home.
(b) Each licensee shall submit documentation
for each individual at least 18 years of age or older to request a
fingerprint-based background check from the national crime information center
(NCIC) database, a request to the department to conduct a background check by
the Kansas bureau of investigation (KBI) and for each individual 10 years of
age and older to request a background check by the Kansas bureau of
investigation and of the abuse and neglect registry maintained by the Kansas
department for children and families before any of the following occurs:
(1) A new individual at least 10 years of age
begins residing in the family foster home.
(2) A new substitute caregiver at least 14
years of age begins caring for the child in foster care in the family foster
home.
(c) Each individual
submitting an initial application for a family foster home license shall obtain
a child abuse and neglect registry background check from each previous state of
residence throughout the five-year period before the date of application for
each individual at least 18 years of age residing in the home.
(d) Background checks shall be obtained
following the procedures of the department.
(e) All fees associated with NCIC checks
shall be handled in accordance with department policy.
