Kan. Admin. Regs. § 44-13-103 - Prosecution by outside agency
(a) When an
inmate allegedly commits an act covered by criminal law, the case shall be
referred to the appropriate law enforcement or prosecutorial agency for
consideration for prosecution unless the prosecutor provides a written
statement requesting that certain types or classes of crimes not be reported,
or requesting that no report be made.
(b) Notification for prosecution by outside
agency shall not preclude a disciplinary charge and proceeding by the
correctional facility for the rule infraction arising from the same facts. The
hearing officer may proceed or continue the case to await the outcome of the
prosecution by the law enforcement agency.
