Kan. Admin. Regs. § 44-15-201 - Special kinds of problems
(a) If an inmate
wants to bring a problem to the attention of a higher authority without going
through the grievance procedure, the inmate may address as official mail a
sealed letter or grievance report form to the warden of the facility, the
secretary of corrections, or the state pardon attorney. However, these letters
or grievance report forms should be reserved for the most difficult and complex
problems. Generally, any matter that can be internally handled under the inmate
grievance procedure shall not be considered as appropriate for the use of the
official mail correspondence privilege.
(b) Any department of corrections or facility
official who receives a complaint letter may return it to the inmate with
instructions to the inmate to make use of and follow the proper grievance
procedure if, in the opinion of the official, the matter is appropriate for
handling through the grievance procedure.
This amendment shall be effective on and after February 15, 2002.
