Kan. Admin. Regs. § 5-45-17 - Exemption floodway fringe fills
Floodway fringe fills are exempt from applying for and obtaining approval from the chief engineer if:
(a) they are:
(1) up to 1600 cubic yards in size;
(2) with a maximum height of two
feet;
(3) more than 100 feet away
from any other floodplain fills; and
(4) constructed according to the design
criteria in K.A.R. 5-45-15; or
(b) they are located in communities which
have adopted local standards for floodway fringe fills approved by the chief
engineer which meet or exceed the standards adopted by the chief engineer for
individual floodway fringe fills. The standards shall include an appeal
process, an environmental assessment and a review of local drainage.
