Kan. Admin. Regs. § 51-13-1 - Employer's election to come under the act

(a)
(1) A parent company shall not file an election to cover itself and a subsidiary; each entity shall file an election on its own behalf.
(2) Failure of an employer to cover its employees by means of insurance policy or through an approved self-insurance plan shall result in the employer being a non-qualified self-insurer and shall result in the employer paying direct compensation benefits to the injured employee.
(b) The election by individuals, partners, and all self-employed persons to bring themselves within the provision of the workers compensation act shall be signed by the individual or partner and by a representative of the insurance carrier issuing the insurance policy.
