Kan. Admin. Regs. § 91-40-25 - Opportunity to examine records and participate in meetings
(a) Each agency
shall allow the parents of an exceptional child an opportunity to inspect and
review all education records and participate in any meeting concerning their
child with respect to the following:
(1) The
identification, evaluation, or education placement of the child; and
(2) the provision of FAPE to the child.
(b) Each agency shall
take steps to ensure that one or both of the parents of an exceptional child
are present at each meeting concerning their child or are afforded the
opportunity to participate. These steps shall include the following:
(1) Scheduling the meeting at a mutually
agreed-upon time and place and informing the parents of the information
specified in subsection (c) of this regulation; and
(2) providing prior written notice of any
meeting, in accordance with subsection (c) of this regulation, to the parents
of the child.
(c) The
notice required in subsection (b) of this regulation shall indicate the
purpose, time, and location of the meeting and the titles or positions of the
persons who will attend on behalf of the agency or at the agency's request.
(d) If neither parent of an
exceptional child can be physically present for a meeting concerning the child,
the agency shall attempt other measures to ensure parental participation,
including individual or conference telephone calls.
(e) As used in this regulation, a meeting
shall not include the following:
(1) Informal
or unscheduled conversations involving agency personnel and conversations on
issues including teaching methodology, lesson plans, or coordination of service
provision if those issues are not addressed in the child's IEP; and
(2) preparatory activities that agency
personnel engage in to develop a proposal or response to a parent's proposal
that will be discussed at a later meeting.
