Kan. Admin. Regs. § 98-5-5 - Assignment
Each water purchase contract shall have the following provisions:
(a) The purchaser shall
not assign, sell, convey, or transfer all or any part of the water purchase
contract or interest in it, unless and until the assignment, sale, conveyance,
or transfer has been approved by the director and the authority.
(b) To request permission to assign, sell,
convey, or transfer all or any part of a water purchase contract, the purchaser
shall provide information requested by the director to consider the
request.
(c) Before approving any
assignment, sale, conveyance, or transfer of all or any part of the water
purchase contract, the authority shall determine that both of the following
conditions are met:
(1) The contract was
negotiated and signed by the parties to the contract pursuant to
K.S.A. 82a-901a et seq. and
K.S.A. 82a-1301 et seq., and amendments
thereto.
(2) The assignment is
consistent with, and will advance, the purposes specified in
K.S.A. 82a-901a et seq., and amendments
thereto.
