310 CMR, § 40.0853 - Performance Standards
(1) A Phase III
evaluation shall result in:
(a) the
identification and evaluation of remedial action alternatives which are
reasonably likely to achieve a level of No Significant Risk considering the oil
and hazardous material present, media contaminated, and site characteristics;
and
(b) the recommendation of a
remedial action alternative that is a Permanent or Temporary Solution, where a
Permanent Solution includes measures that reduce, to the extent feasible, the
concentrations of oil and hazardous material in the environment to levels that
achieve or approach background.
(2) A Phase III Remedial Action Plan shall
describe and document the information, reasoning and results used to identify
and evaluate remedial action alternatives in sufficient detail to support the
selection of the proposed remedial action alternative.
