310 CMR, § 40.0896 - Possible Outcomes
Upon completion of operation, maintenance and monitoring activities under Phase V, the following outcomes are possible:
(1) the requirements of a Permanent Solution
under
310
CMR 40.1000 have been met and no additional
operation, maintenance and/or monitoring of the remedial action alternative is
necessary to ensure the integrity of the Permanent Solution. A Permanent
Solution Statement shall be submitted to the Department;
(2) the requirements of a Permanent Solution
under
310
CMR 40.1000 have been met but conditions
apply to maintaining the Permanent Solution. A Permanent Solution with
Conditions Statement shall be submitted to the Department;
(3) the requirements of a Temporary Solution
under
310
CMR 40.1000 have been met and no additional
operation, maintenance and/or monitoring of the remedial action alternative is
necessary to ensure the integrity of the Temporary Solution. A Temporary
Solution Statement shall be submitted to the Department; or
(4) the requirements of a Temporary Solution
under
310
CMR 40.1000 have been met, a Temporary
Solution Statement has been submitted to the Department, and additional
Post-temporary Solution Operation, Maintenance, and/or Monitoring of the
remedial action alternative under
310
CMR 40.0897 and
310
CMR 40.0898 is necessary to ensure that the
conditions upon which the Temporary Solution is based are maintained and/or
that further progress toward a Permanent Solution is made.
