940 CMR 23.05 - Priorities
In entering into Brownfields Covenant Not to Sue Agreements, the Commonwealth shall give first priority to Sites located in the 15 cities with the highest poverty rate in the Commonwealth, second priority to Sites located in an Economically Distressed Area, and third priority to all other Sites. The identification of the 15 cities with the highest poverty rate will be determined using United States census data compiled by the Donahue Institute's Economic and Public Policy Research Unit at the University of Massachusetts at Amherst.
