Mich. Admin. Code R. 125.1011 - Duties and powers of presiding officer
Rule 11.
(1) The
presiding officer shall conduct a fair and impartial hearing, assure that the
facts are fully elicited, adjudicate all issues, and avoid delay.
(2) With respect to cases assigned to him or
her between the time the case is assigned and the report is issued subject to
the provisions of chapter 4 of Act No. 306 of the Public Acts of 1969, as
amended, being S24.271 et seq. of the Michigan Compiled Laws, the presiding
officer shall have the powers set forth in section 80 of Act No. 306 of the
Public Acts of 1969, as amended, being S24.280 of the Michigan Compiled Laws.
The presiding officer shall also have authority to prepare proposed declaratory
rulings pursuant to
R
125.1025.
