Mich. Admin. Code R. 28.1105 - Rule 105. Impounding of vehicles; authority; procedure; public sale
(1) Notwithstanding section 252d of the act,
a police agency may provide for the immediate removal of a vehicle from public
property or any other place open to travel by the public and impound the
vehicle in any of the following circumstances:
(a) When a vehicle is left unattended on a
bridge, viaduct, causeway, subway, tube, or tunnel where the vehicle
constitutes an obstruction to traffic.
(b) When a vehicle is found being driven on
the streets or highways in an unsafe condition that endangers persons or
property.
(c) When the driver of
the vehicle is taken into custody by the police department and the vehicle
would thereby be left unattended on the street.
(2) A police agency that authorizes the
removal of a vehicle under subrule (1) of this rule shall comply with the
requirements of section 252d(2) to (7) of the act.
