Mich. Admin. Code R. 299.4112 - Emergency disposal; conditions for approval
Rule 112.
(1) If a
material poses a threat or substantial nuisance to the public or the
environment, a person may petition the director to approve the emergency
disposal of the material as follows:
(a) At a
location that is not licensed pursuant to the provisions of the act .
(b) At a disposal area that is licensed
pursuant to the provisions of the act , but is not authorized by a county
plan.
(c) In a manner that is not
in accordance with the provisions of the act or these rules.
(2) Approval of emergency disposal
by the director , or his or her designee, if granted, shall be in compliance
with all of the following provisions:
(a) Be
oral or written. If oral, it shall be followed by written approval within 5
days.
(b) Not be more than 90 days
in duration.
(c) Clearly specify
the type and quantity of material and the manner and location of its
disposal .
