Mich. Admin. Code R. 325.9205 - Nonsubstantive reviews; eligibility
Rule 205.
(1) A
person may submit a letter of intent requesting a nonsubstantive certificate of
need review.
(2) The department
shall approve the request as appropriate when the department is satisfied that
all of the following conditions have been met:
(a) The completed project will not result in
any of the following:
(i) An increase in the
number of beds licensed to the applicant at the licensed site at which the
project is proposed.
(ii) The
initiation or expansion of a covered clinical service.
(iii) Beginning operation of a new health
facility at a site that is not currently licensed for that type of health
facility.
(iv) A capital
expenditure in excess of a covered capital expenditure as defined in the
code.
(b) The proposed
project is not subject to comparative review under the code or the applicable
certificate of need review standards.
(3) The department may accept other projects
for nonsubstantive review under section 22233 of the code. The department shall
maintain a public list of the types of projects eligible for nonsubstantive
review under this rule.
