Mich. Admin. Code R. 325.9401 - Validity of certificate
Rule 401.
(1) A
certificate of need is valid only as long as there is compliance with the
provisions in the final or amended application, including project timetables
except as expressly modified in the certificate of need and its
amendments.
(2) As provided by
section 20164(2) of the code, the certificate of need is not transferable and
shall be valid only for the persons, buildings and properties stated in the
certificate. The recipient of a certificate of need shall comply with all of
the following provisions:
(a) The certificate
of need.
(b) The amendments to the
certificate of need.
(c) The
application to the extent it has not been modified by the certificate of need
and its amendments.
(3)
Only the persons authorized by the certificate of need may offer the covered
clinical services or beds listed in the certificate of need.
