Mich. Admin. Code R. 330.1299 - Waiver of licensure requirements
Rule 1299.
(1) The
director may issue a temporary waiver of a requirement for licensure when:
(a) There is a justifiable and documented
reason why the requirement cannot be met.
(b) Temporary waiver of the requirement would
not significantly reduce effective treatment, nor adversely affect the health
of patients.
(c) All other
requirements are met.
(d) The
provisions of the mental health code are not violated.
(2) A waiver of a requirement shall be for 1
year and may be renewed if:
(a) The applicant
shows evidence that significant attempts were made to meet the
requirement.
(b) Services to
residents were not significantly affected because the licensee has not met the
requirement.
(3) A
request for waiver, and supporting arguments, shall accompany the original
application for license and subsequent annual renewals, when
applicable.
