Mich. Admin. Code R. 408.30406 - Building Official Right of Entry
Rule 406. Section 104.6 of the code is added to read as follows:
104.6. Right of entry. If a
structure or premises is unoccupied, the building official shall first make a
reasonable effort to locate the owner or other person having charge or control
of the structure or premises and request entry. If a building or premises are
occupied, the building official shall present credentials to the occupant and
request entry. If entry is refused, the building official shall have recourse
to the remedies provided by law to secure entry. When a building official has
first obtained a proper inspection warrant or other remedy provided by law to
secure entry, the owner, owner's authorized agent or occupant, or person having
charge, care, or control of the building or premises shall not fail or neglect,
after a proper request is made as provided in this rule, to allow the building
official prompt entry into the building or premises to inspect or examine the
building or premises under this code.
