Rule 451c.
Section 1612.3.1 of the code is amended and 1612.4.1 is added to the code to read as follows:
1612.3.1. Alternate flood hazard provisions.
Absent the adoption of a flood hazard map and supporting data, flood hazard
areas as determined by the state under its administration of the Part 31,
floodplain regulatory authority of the natural resources and environmental
protection act, 1994 PA 451, MCL
324.101 to
324.90106,
shall become the basis for regulation of floodplain development within the
community and section 1612 shall apply to buildings and structures within those
areas.
1612.4.1. Minimum
requirements for buildings and structures. All of the following are in addition
to the requirements of ASCE 24:
(1) Buildings
and structures in flood hazard areas subject to high velocity wave action (zone
V) shall be in compliance with the requirements of ASCE 24 for such flood
hazard areas.
(2) The lowest floors
of structure category II buildings and structures shall be at or above the
elevation specified in ASCE 24 or 1 foot (305 mm) above the design flood
elevation, whichever is higher.
(3)
The lowest floors of structure category III and IV buildings and structures in
flood hazard areas not subject to high velocity wave action (zone A) shall be
at or above the elevation specified in ASCE 24 or 1 foot (305 mm) above the
500-year flood elevation, whichever is higher. For the purpose of this
requirement, the 500-year flood elevation is the elevation of flooding having a
0.2% chance of being equaled or exceeded in any given year.
(4) Dry floodproofing for structure category
II buildings and structures shall extend to or above the elevation specified in
ASCE 24 or 1 foot (305 mm) above the design flood elevation, whichever is
higher.
(5) Dry floodproofing for
structure category III and IV buildings and structures shall extend to or above
the elevation specified in ASCE 24 or 1 foot (305 mm) above the 500- year flood
elevation, whichever is higher. For the purpose of this requirement, the
500-year flood elevation is the elevation of flooding having a 0.2% chance of
being equaled or exceeded in any given year.
(6) The interior floor or finished ground
level of under-floor spaces and crawlspaces shall comply with section
1805.1.2.1 of this code.
