Mich. Admin. Code R. 408.7007 - Responsibility for elevator operation and maintenance
Rule 7.
(1)
Responsibility for the operation and maintenance of elevators is as follows:
(a) The person, firm, or corporation
installing, repairing, relocating, or altering an elevator is responsible for
its operation and maintenance until the certificate of operation is issued,
except as provided for in
R 408.7012, and is
responsible for all tests of new, repaired, relocated, and altered equipment
until the certificate of operation is issued.
(b) The holder of a certificate of operation
or duly appointed agent is responsible for the safe operation and proper
maintenance of the elevator.
(c)
The holder of the certificate of operation is responsible for all periodic
inspections and tests, securing the renewal of the certificate of operation,
and the compliance with violation notices.
(d) The licensed contractor holding a
temporary certificate of operation is responsible for the safe operation,
maintenance, repair, replacement, testing, and fees of the elevator during the
period that the temporary certificate is in force.
(2) Safety tests must be performed by
elevator journeypersons who are licensed in this state.
