Mich. Admin. Code R. 432.714b - Proceedings
Rule 714b.
(1) The
burden of proof is at all times on the petitioner. The petitioner has the
affirmative responsibility of establishing, by clear and convincing evidence,
any of the following:
(a) The petitioner
should have been awarded a license.
(b) The license should have been
renewed.
(c) The transfer of
ownership should have been approved.
(d) Approval should have been
granted.
(2) The hearing
must be conducted in accordance with the administrative procedures act of 1969,
1969 PA 306, MCL 24.201 to 24.328, except as otherwise provided in these rules
or the act.
