Mich. Admin. Code R. 792.10102 - Construction of rules
Rule 102.
(1) These
procedural rules shall be construed to secure a fair, efficient, and impartial
determination of the issues presented in contested cases consistent with due
process.
(2) These rules are not
intended to displace any statutorily mandated procedure. If a statute
prescribes a procedure that conflicts with these rules, the statute
governs.
(3) If an applicable rule
does not exist, the 1985 Michigan rules of court and the provisions of chapter
4 of the administrative procedures act of 1969, 1969 PA 306, MCL 24.271 to
24.287 apply.
(4) A heading or title
of a part or section of these rules shall not be considered as a part of the
rules or used to construe these rules more broadly or narrowly than the text of
these rules would indicate, but shall be considered as inserted for the
convenience to users of these rules.
