Mich. Admin. Code R. 792.11108 - Modification of abatement period; hearing; processing; petition
Rule 1108. Where a petition is objected to by the department or affected employees, the petition shall be processed as follows:
(a) The hearing on the
petition shall be handled in an expeditious fashion.
(b) An employer petitioning for a
modification of an abatement period shall have the burden of proving by a
preponderance of the evidence that he or she has made a good faith effort to
comply with the abatement requirements of the citation and that abatement has
not been completed because of factors beyond his or her
control.
