Minn. R. agency 171, ch. 7411, ADMINISTRATIVE ENFORCEMENT ACTIONS, pt. 7411.1900 - CEASE AND DESIST ORDER
The commissioner, or a department employee designated by the commissioner, may issue an order to cease a program or instructor's activity if continuation of the activity would result in an immediate risk to public safety.
A. An order issued under this
part is effective for a maximum of 72 hours.
B. In conjunction with the issuance of the
cease and desist order, the commissioner may post a sign to cease an activity
until the cease and desist order is lifted and the sign is removed by the
commissioner.
C. To enjoin the
violation after the 72 hours has expired, the commissioner must either:
(1) seek injunctive relief in a district
court in Ramsey County or, at the commissioner's discretion, in a district
court in the county in which the violation occurred; or
(2) pursue other administrative action as
provided in this part.
