Minn. R. agency 196, ch. 9505, MEDICAL ASSISTANCE PAYMENTS, pt. 9505.0200 - COMPETITIVE BIDDING
Under certain conditions, the commissioner shall seek competitive bids for items designated in Minnesota Statutes, section 256B.04, subdivision 14, and for durable medical equipment. Competitive bids are required if the item of durable medical equipment is available from more than one manufacturer and at least one of the following conditions exists:
A. the projected fiscal year savings of
medical assistance funds, resulting from purchase of the item through the
bidding procedure, exceeds the cost of administering the competitive bidding
procedure. The projected savings in a fiscal year must be computed by
determining the difference between actual expenditures for the item in the
previous fiscal year and an estimated expenditure based on the actual number of
units purchased times the predicted competitive bid prices; or
B. the item is a new item that was not
available during the previous fiscal year but is estimated to be cost-effective
if purchased by competitive bidding. Competitive bidding for a new item is
considered cost-effective if the projected annual cost at predicted competitive
bid prices is less than the projected annual payments at a reimbursement level
which would be set by medical assistance in lieu of competitive bid.
