1 Miss. Code. R. 11-2.3 - Scope and Effective Date
A. These rules
apply only to the administrative control and leasing responsibilities of the
Secretary of State regarding public trust tidelands. They do not apply to
activities under the respective jurisdictions of the Department of
Environmental Quality and/or the Department of Wildlife, Fisheries & Parks.
These rules are considered cumulative; a person desiring a lease or affected by
an administrative decision pursuant to these rules should consult other
applicable federal, state and local laws and/or rules and
regulations.
B. These rules are
prospective in their application and shall not affect previously issued
easements or leases concerning public trust tidelands. Fees and lease fees
required under existing leases are not subject to the lease fee calculations
set forth in these rules until the expiration(s), termination(s) and/or
cancellation(s) of those leases, unless otherwise set forth in the existing
lease contract.
