(a) The Commission
Chairman or the hearing examiner may allow any person interested in a contested
case brought before the Commission by or against the Executive Director to file
a document or portions of a document with the Commission under seal if:
1. The document or portions of the document
contain information that is confidential pursuant to the Act or these
regulations;
2. The person makes a
request in writing or on the record of a public hearing to allow the filing of
the document or portions of the document under seal, setting forth the reasons
that such filing under seal should be permitted;
3. The person requesting the filing of the
document or portions of the document under seal has, to the extent practicable,
segregated the portions of the document containing confidential information
from the remainder of the document so that no more of the document than is
necessary is filed under seal; and
4. The Commission Chairman or the hearing
examiner finds that the public interest in maintaining the confidentiality of
the information outweighs the public interest in making the information
public.
(b) The

following documents under seal:
1. Complaints
for disciplinary action;
2. Answers
to complaints for disciplinary action;
