13 Miss. Code. R. 2-1.13 - Withdrawal Of Application
(a) A request for
withdrawal of an application may be made at any time prior to final action upon
the application by the Commission by filing a written request to withdraw with
the Executive Director.
(b) The
Executive Director may, in his discretion, deny the request, or grant the
request with or without prejudice. If the request is denied or granted with
prejudice, the applicant may appeal to the Commission within ten (10) days of
the Executive Director's decision.
(c) If a request for withdrawal is granted
with prejudice, the applicant is not eligible to apply again for licensing or
approval until after expiration of one (1) year from the date of such
withdrawal.
(d) The Executive
Director shall notify the applicant in writing whether its request for
withdrawal has been granted with or without prejudice or denied.
