18 Miss. Code. R. 14-12.6 - Ineligibility for Failure to Comply
A. A nonexempt
individual who refuses or fails without good cause (as defined in
Rule
12.12 Good
Cause) to comply with general SNAP work requirements is
ineligible to participate in SNAP and will be considered an ineligible
household member.
B. MDHS must
determine if good cause exists once it learns of the individual's
noncompliance.
C. MDHS must provide
an individual a notice of adverse action within 10 days of establishing that
noncompliance was without good cause.
1. The
notice of adverse action must contain the particular noncompliance act and the
proposed disqualification period.
2. The notice must specify what actions can
be taken to avoid disqualification prior to the beginning of the
disqualification period.
3. The
notice must also state the individual may reapply, if appropriate, at the end
of the disqualification period.
